III.1 Nature of Personal Data Collected “Personal Data” refers to any personal information as defined by applicable laws and regulations regarding personal data, notably the General Data Protection Regulation (GDPR) of April 27, 2016, that users may provide to APG when creating an account on the Site or “Enquirie.” This data includes, but is not limited to, names, surnames, date of birth, account identifier and password registered on the Site, email address, postal address, phone number, and possibly users’ bank details. This Personal Data, regardless of its nature, may allow APG to identify and better understand users and respond to their messages or form submissions on the Site. The user agrees to answer the questions posed during the use of the Site’s forms and to provide APG with complete, accurate, up-to-date information that does not harm the interests or rights of third parties. In the event of failure to provide this information or providing incorrect Personal Data, APG cannot be held responsible for the non-receipt of communications and offers or for the non-processing of a request submitted on the Site.
III.2 Consent No Personal Data is collected without the users’ consent. By sending a message via the “Contact” or “Enquirie” sections of the Site or by creating a customer account on the Site, the customer consents to the collection and processing of their Personal Data by the Company. The optional or mandatory nature of the information to be communicated to APG during the collection on the Site will be indicated to users in advance. Users are not obliged to provide Personal Data to APG.
III.3 Identity of the Data Controller The company APG is responsible for the collection and processing of the personal data of users of the Site.
III.4 Recipients of Personal Data APG is generally the sole recipient of the Personal Data collected on the Site. APG only shares Personal Data with third parties in the following cases: – The user has given prior consent for the sharing of their Personal Data, – APG must share this information with third parties to provide users with the requested service, – APG is required by a judicial authority or any other administrative authority to disclose Personal Data.
III.5 Use of Personal Data The Personal Data related to users collected on the Site is processed by APG in accordance with applicable laws and regulations regarding personal data, notably the GDPR. APG uses the Personal Data provided by users for the following purposes: – Sending newsletters and event or commercial communications; – Commercial prospecting.
III.6 Retention of Personal Data User data is retained for a period of three (3) years from the date of account creation or the last operation performed by the customer from their account, except for the storage of bank information, which is retained for 10 years.
III.7 Users’ Rights In accordance with Articles 15 and following of the GDPR, each user has the right to access, rectify, complete, update, lock, or delete their Personal Data and, for legitimate reasons, to object to its processing. III.8 Cookies When visiting the Site, information related to the user’s browsing (computer, tablet, smartphone, etc.) may be recorded in “Cookies” files installed on the user’s device.
